Government under the articles of confederation

Although the system of national government provided by the articles of confederation had a number of weaknesses it did also have a few accomplishment.The articles of confederation were the first frame of government for the united states, it was drafted by the congress in 1777 and in effect from 1781 until 1788. It was replaced by the constitution.
The biggest accomplishment of the government under the Articles of confederation would be the winning of the American revolutionary war also known as the American war of independence. Another would be the the negotiation of the treaty of Paris in 1783. The treaty of paris gave America control of the region between Canada and Florida east of the Mississippi river. It also gave Americans the right to fish in Atlantic waters off of canada.
There were more weaknesses than accomplishments under the articles of confederation. One of the weaknesses would be economic problems, congress had to borrow large amounts of money by selling selling interest-bearing bonds and paying soldiers and suppliers in missives that they could redeem for cash in the future, to finance the the American revolutionary war also known as the American war of Independence. With a lack of a stable source of income it found itself unable to pay interest nor debts.
Another weakness would be that under the confederation the power resided in the thirteen states and not in the government as a whole it was to weak to enforce laws. For instance congress had no power to tax citizens or commerce directly. A passage of a law was required to have the vote of nine out of the thirteen states, majority of the states didn’t approve of anything during the seven years that the articles of confederation were active. The government had one house legislature, Congress, with a delegate from each state, no judicial branch or chief executive. The congress also didn’t have provision for a national army, but it needed to request that individual states contribute troops.
Federalism is a system of government in which power is divided between the central government and the states. Federalism also known the system of checks and balances and as the division of powers between the different branches of government in other words the separation of powers. Federalism is the relationship between the national government and the states, unlike the articles of confederation the constitution strengthened the authority of the government. For example it gave congress the power to impose taxes, regulate commerce, declare war, etc. It also authorized the president to enforce laws and control the military. Meanwhile most habitual matters of the government like education and law enforcement still lie in the control of the states, this is still a debate today.
The separation of powers better known as checks and balances is the way the constitution tries to prevent any branch of government from overpowering the other two. Congress can act laws but the president has the right to veto them. The president can be impeached by the house of representatives and taken from office by the senate for crimes and misdemeanors.
The constitutional convention was a meeting in philadelphia that took place from may 25, 1787 until september 17,1787. Representatives from twelve states all except Rhode Island meet up during these months to revise the articles of confederation the meeting consisted of fifty-five men in total. The meetings resulted in the production of a new constitution. All delegates agreed on having a legislative, Executive and judicial branches.
In my opinion the most significant compromise resultings from the constitutional convention in philadelphia would be the making of three branches. I say this because unlike the articles of confederation the power is split into different sections, so all power isn’t going to one person or group like a monarchy. Checks and Balances aka separation of powers is what this is called. This is significant because it doesn’t allow one branch to just take control over everything without the consent of others. For example if a president negotiates a treaty it still has to be accepted by the senate to be approved. This stops one branch from over too much power even the the judicial branch is considered to be the highest branch of all three.
Cruel & unusual punishment

Cruel and unusual punishment is punishment that is to be unacceptable due to the suffering, pain, or humiliation it inflicts on the person subjected to it. Even though cruel and unusual is prohibited in the United states it is still being practiced. Is it because the courts haven’t all decided what is to be considered cruel and unusual? The biggest controversy over this is who receives cruel and unusual punishment. Mostly people of color for petty crimes that don’t correlate with the punishment that they receive.
Does a systematic form of “Cruel and Unusual Punishment” exist today? Indeed it does, there are people being sentenced to lengthy periods of time for petty crimes and other harsh punishments. In the book Just mercy Bryan Stevenson brings up a few cases one stuck out the most to me. In 1989 a thirteen year old by the name of Joe sullivan robbed a house with two other young males. They were stopped by the police and sullivan was accused of raping the woman whose house they robbed. The dna of the person who really raped the woman was destroyed and Joe Sullivan was sentenced to life in prison. While in prison Joe sullivan was raped multiple times and attempted to committed suicide, he then multiple sclerosis due to the trauma of him constantly being raped. Sullivan wrote to Stevenson’s foundation about his situation and his petition was denied by court in Florida, Stevenson then took this case to the supreme court. The eighth Amendment states that “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
This has caused a continuation of prison slavery, I say this because some prisons are forcing their inmates to work without pay. Some of the inmates probably had good paying jobs outside of the prison and now they’re doing sentences for crimes they didn’t commit or because their skin color. For the inmates that are getting paid at some prisons Costs for room and board in prison are extracted from their payment, also fees for alimony and/or child support, and With whatever is left prisoners must pay for products at the commissary and phone calls. In some cases inmates are trying to support family members outside the prison with little to no money that they make. Just recently Florida voted to restore the voting rights of ex-felons using the fourth Amendment, so many people are convicted of crimes that they may or may not have committed and aren’t able to vote while in prison or in some cases when they’re released.
In my opinion cruel and unusual punishment still goes on today, people are being convicted of crimes that they didn’t commit and being sent to prison with bad living conditions. People are getting raped day and night and beaten to near death by other inmates, people who may or may not belong there. I feel like it is not fair to veto the voting rights of ex-felons, they’re apart of society too. If you do work you should be paid for it no, matter the circumstance.
Growth of the ethnic market
In my opinion the growth of the ethnic market is stupendous. I say this because it wasn’t easy for people of color to have the right foundation or get certain jobs in the beauty industry. In one of the articles that I read by the new york times, they talk about a model named Iman who worked during the 70s and 80s, having to blend her foundations to get her correct color she later created her own makeup line because of this. Photography plays a major role in not fulling the beauty needs of women of color. The article talks about photographers not being able to light women if color. I’ve noticed that some women of color look lighter in professional pictures and civilians would accuse them of bleaching their skin, but in all honesty their picture just had too much lighting.
The article also talks about celebrity women of color who wear their hair in its natural state and don’t feel ashamed about it. I wholeheartedly agree with this. Nobody should have to assimilate to another culture because that’s what society feel is “right” or “better looking”. Rihanna a pop singer of the 2000s created her own cosmetic line called Fenty beauty. A line that covers all shades of beauty from the lightest to the darkest. It has been a hit ever since it was released back in 2017, an article by W magazine talks about Rihanna’s Fenty Beauty ushering in a new era of inclusivity in the beauty industry.
